Prenuptial Agreement. Do I need one? Why? How?

A Prenuptial agreement is a legally binding financial agreement. Also know as a prenup agreement, it is a way of recording what each person is bringing into a relationship – whether marriage or defacto. It is not created in expectation of a divorce. Rather a prenuptial agreement can help a couple talk through important issues.

A prenuptial agreement requires that EACH person receives INDEPENDENT financial / legal advice. This is a safeguard to ensure one person is not forced to sign against their will or unaware of the implications of the prenuptial agreement.
