How does family violence impact my rights in Family Law?

The definition of violence has recently been expanded in the Family Law Act. Violence can include physical, verbal and financial violence.

The Courts will make special provisions for parties who are the victims of family violence. This includes dispensing with the requirement of attending family dispute resolution prior to filing an application for children’s orders or arranging for separate conferences while at Court. The Court will even provide safe rooms and entry and exit plans upon request.

Family violence may impact upon financial entitlements in certain circumstances, particularly if the nature of the violence has been so extreme as to affect the contribution of the victim.

How can you be protected?

The Police can apply for an order on your behalf for your protection. These orders are known as Apprehended Domestic Violence Orders (ADVO). A breach of an ADVO is a criminal offence.
