Does the mother get preference in disputes of child custody?

No. Every child custody matter is determined by the relevant facts of the matter. In some instances, where the child is very young and the mother has been the infant’s primary caregiver, it is likely the Court would make an order consistent with primary care awarded to the mother of the child for a defined period. This does not mean that the father of the child will not be granted significant time with the child.
