What is probate?

Probate is essentially the process by which the person named as the legal representative of the deceased person approaches the Supreme Court, as the highest authority in the land (of New South Wales) and requests that the court “prove” or approve the applicant as the executor.

The Court, in granting the probate, determines that the document annexed to the probate application is the last will of the deceased. The Court applies its “seal” to the document, which means that the person named as the executor is the approved legal representative of the deceased person.
