Can I keep the assets I brought into the marriage?

It depends on the circumstances. As asset division is determined largely on the basis of contributions, the other party may have made ongoing contributions to that asset during the course of the relationship. The initial contributions are generally given more weight in favour of the party who brought in the asset in the following circumstances:

  • In a short marriage (under 10 years)
  • The size of the contribution relative to the size of the asset pool
  • If that contribution was a ‘springboard’ for later assets.
